An appeal court in Port Harcourt, Rivers state, has struck out the suit challenging the emergence of David Lyon as the governorship candidate of
the All Progressive Congress.
The three-man panel also struck out the appeal of Senator Heineken Lokpobiri describing it as statute barred.

Three appeals were filed by David Lyon, Heineken Lokpobiri and the All Progressives Congress against the judgement of the Federal High Court,
Yenagoa which held that they were products of flawed primaries on the 4th of September, 2019.
The Judges held that Senator Lokpobiri failed to comply with the statutory 14 days period, describing it as statute barred. The Appeal Court also overturned the judgement of the lower court.
Supporters of David Lyon were also in court to witness the judgement of the Court of Appeal.
