Agbakoba asks Court to declare procedure for suspending Onnoghen unconstitutional

Image result for Agbakoba asks Court to declare procedure for suspending Onnoghen unconstitutionalA former President of the Nigerian Bar Association, Olisa Agbakoba  has asked the Federal High Court, Lagos Division to declare as unconstitutional the procedure adopted by President Muhammadu Buhari to suspend the Chief Justice of Nigeria,  Walter Onnoghnen.

Agbakoba, in  a statement by his Media Assistant on Thursday, Niyi Odunmorayo, said there are laid down procedures for removing the CJN, which he claimed the president did not follow.

He said: ” The grounds of the claim is that Judicial Officers including the Chief Justice of Nigeria enjoy Judicial Immunity and have constitutionally guaranteed tenure of office that can only be interfered with by the administrative action of the National Judicial Council or the President acting on an address supported by two thirds majority of the Senate.

“In the suspension of the Chief Justice of Nigeria, Justice Walter Samuel Nkanu Onnoghnen, the President of Nigeria did not adopt either of the procedures,” Agbakoba said.
