Chairman of the Code of the Code of Tribunal, Danladi Umar, on Tuesday, held that the restraining order made by the Federal High Court and the Industrial court is not binding on the tribunal.
Daladi said that the Code of Conduct Tribunal has jurisdiction to determine breach of code of Conduct by any public officer.
The CCT chairman stressed that the under the 3rd schedule of the 1999 constitution as amended, that order of any high court cannot stop the tribunal from exercising its powers under the constitution citing section 246 of the constitution of Nigeria.
Meanwhile, Atedze Agwaza, a member of the 3- man panel in his ruling disagreed with the chairman of the CCT and agreed with the defence counsel in all his submissions. But the third panelist, Julie Anabor agreed with the chairman of the CCT and adopted in totality his ruling.
However, Atedze Agwaza’s disagreement does not nullify the decision of the other two members of the panel.
Tribunal has now adjourned till 28th January for hearing of preliminary objections challenging the jurisdiction of the court.
