Applicants seek disqualification of Adeleke as Senator representing Osun west

Image result for Applicants seek disqualification of Ademola Adeleke as Senator representing Osun westAn application seeking the disqualification of Senator Ademola Adeleke as the Senator representing Osun West Senatorial district, has been lodged at the Federal High Court in Abuja.

TVC news Judiciary correspondent Celestina Iria reports that in the application dated 26th of April 2019, the plaintiffs in the suit Akinwale Olaniyi and Akinjide Monsuru are seeking that the court restrains Senator Ademola Adeleke from further parading himself as a senator representing Osun West Senatorial district of Osun State.

The plaintiffs are praying for an order of the court directing Mr Adeleke to refund all salaries, allowances and other emoluments he has received as
Senator.

These prayers are brought pursuant to section 65(2)(a) of the 1999 constitution and the judgment of an FCT high court sitting in Bwari, delivered on the 2nd of April.

Justice Othman Musa of the FCT high Court in Bwari had on the 2nd of April held that Mr Adeleke did not possess the minimum qualification of being educated up to secondary level as stipulated under section 177 of the 1999 Constitution.

He added that the results Mr Adeleke attached to his form CF001 which he submitted to INEC and used in contesting the governorship election under
the PDP in Osun was fake.

He stressed that the result was found to be different from the one presented to the court by the Principal of Ede Muslim High School, Ede, where he claimed to have graduated.

The plaintiffs are also seeking an order directing INEC to withdraw the certificate of return already issued to Mr Adeleke as the elected senator
representing Osun West Senatorial District.
