An Abuja High Court court will on 25th of May rule on whether to vacate an earlier order granted to the Department of State Security Services, DSS to further detain owner of capital Oil, Ifeanyi Ubah, pending completion of its investigation on conversion of Premium Motor Spirit, PMS products.
Ifeanyi Ubah was alleged to have converted to his personal use, PMS products belonging to the Nigerian national petroleum corporation, NNPC kept in his custody at his tank farm.
At the Tuesday hearing , Ifeoma Esom who represents Ifeanyi Ubah in a motion on notice, prayed the court to vacate it’s earlier order granted to the DSS for continued detention of the respondents while investigation is still on going.
She further argued that there can be no issue of crime in conversion of the products as records show that NNPC is owing over 10 billion naira to capital oil.
Counsel to DSS, Gabriel Agbadua, said that the NNPC had repeatedly asked for a redelivery of the 80 million litres of PMS products which he failed to do amounting to a criminal and capital offence.
Justice Yusuf Haliru, subsequently adjourned to 25th of may for ruling.
