A constituent of the Edu/Moro/Patigi constituency in Kwara state Haruna Salihu has asked the upper area court in Zuba, Abuja to investigate Adamu Saba who is the APC candidate for that constituency for the next House of Representatives elections.
He alleges the APC candidate committed perjury by lying on oath about his educational qualifications.
Exhibits tendered at the federal high court, Ilorin, Kwara State between Ahmed Ndakene Vs Saba Adamu have become a subject of litigation at the upper area court in Zuba.
Ahmed Ndakene had at the Federal high court challenged the outcome of the APC primary election for Edu/Moro/Patagi federal constituency, which the court did not rule in his favor.
At the high court Mr Saba had in a counter affidavit allegedly deposed that he was a graduate of Ahmadu Bello University, which was the basis of another suit by Haruna Salihu.
The nominal complaint by Haruna Salihu in this suit at the upper area court is that Mr Saba did not graduate from Ahmadu Bello University, and that the defendant’s deposition to an affidavit saying he graduated from the university, amounts to perjury.
At the resumed sitting the matter could not go on as the judge presiding over the case was transferred to another division.
A letter requesting for a fiat to be issued directing the judge to continue the case was written by parties.
Until the process is finalized for the judge to continue the case, the matter was adjourned.
The defendant had filed a preliminary objection challenging the jurisdiction of the court.
The complaint is praying the court to refer the Direct Criminal Complaint to the office of the Assistant Inspector General of Police, Force Intelligence Bureau ,pursuant to section 89 (5) of the Administration of Criminal Justice Act (2015).
The Edu/Moro/Patigi Federal Constituency Seat of the National Assembly in contention is currently occupied by Ahmed Ndakene.
