The Election Petition Tribunal in Ibadan has adjourned to deliver judgment in the case filed by the Social Democratic Party (SDP) challenging the victory of Peoples Democratic Party (PDP) candidate, Hon. Fola Oyekunle, in the August 16, 2025, bye-election for Ibadan North Federal Constituency.

The petition is registered under suit number EPT/OY/HR/01/2025.

The adjournment followed the conclusion of the parties’ presentations and the adoption of their written addresses.

SDP argued that the election of Hon. Folajimi to represent Ibadan North federal constituency was flawed due to alleged non-compliance with the Electoral Act 2022. The party requested the tribunal to annul the bye-election and conduct fresh or supplementary elections in the affected polling units.

In response, PDP’s counsel, Tunji Ogunrinde, SAN, filed a preliminary objection questioning the competence of the petition, citing the petitioner’s alleged failure to meet requirements under the Electoral Act 2022. Ogunrinde urged the tribunal to dismiss the petition, describing it as frivolous, baseless, and lacking in merit.
