The Supreme Court has ordered direct payment of federal allocations to local government accounts as against the Joint Account Allocations Committee.
The court declared that the retention of monies meant for local government by the State government is unconstitutional- Supreme Court
” It is the local government council that should control and manage funds belonging to the local government. The adoption of using States to receive monies of the local government is a departure of the 1999 constitution.
The Court also ruled that the practice by state government using a caretaker committee to take control of local government is in breach of section 162 of the Constitution
It described the act as unconstitutional and is gradually making the local government council extinct.
