In a judgment read by Justice Mohammed Idris on behalf of the three-man panel, the court decided to settle the case on the preliminary objection, stressing the need to pay attention to when the cause of action arose.

The court further held that in line with section 285 sub section nine of the constitution, the suit was not filed within the time allowed by law.

The plaintiffs Kalu Kalu, Labaran Ismail and Hassy Kyari el-Kuris, had approached the appellate court to nullify and set aside the judgment of the Federal High Court in Abuja, which declined to hear a suit they instituted to challenge the educational qualification of Mr Buhari before the conduct of 2019 general election.
