The Appeal Court in Port Harcourt has granted the APC’s request for stay of execution of the judgment that disqualified the party from contesting in the forthcoming polls in Rivers state.
It is the latest development in the legal fireworks between two factions of the APC in the state and the Independent National Electoral Commission.
The Port Harcourt division of the Federal High Court had on January the 7th 2019 delivered a judgment that compelled INEC to delist the APC from its list of parties contesting in the elections.
In response to that, one faction of the APC and its governorship candidate, Tonye Cole approached the Appellate Court challenging the judgment of the trial court.
One of the reasons given by the Appeal Court for granting the stay of execution was the duplicity of Appeals that resulted from the Federal High Court Judgment.
As at the last sitting, five appeals on the same matter were before this court. The decision of the Appeal of the court resulted in celebration from one section of the crowd.
