Onnoghen: CCT begins hearing on motion challenging its jurisdiction

The Code of Conduct Tribunal, has commenced hearing on the motion challenging the court’s jurisdiction to hear the case against the Chief Justice of Nigeria, Justice Walter Onnoghen.The CCT had adjourned to 22nd of January to enable the registrar of the CCT, serve the CJN, Walter Onnoghen with charges and summons.

At the last sitting, counsel to the CJN, Wole Olanipekun had argued that the CJN was not served personally, that services was done done through his personal assistant, which is against the provisions of the law

The court adjourned to, today, to hear the motion of jurisdiction raised by the defence counsel and for proper service to be done to the CJN.

The CJN is absent from Court but prosecution and defence counsels are present.

In his opening remark, the prosecution counsel informed the court that the matter was adjourned to today for the arraignment of the CJN and for hearing of the two motions raised, one by the defendant on jurisdiction and the other by the prosecution asking the CJN to set aside from office.

The Defence counsel argued that arraignment can not take place as the defendant is not in Court, and with the record of the last sitting, the court did not adjourn for arraignment but for hearing of the two motions.

Counsel to the defendant, Wole Olanipekun drew the attention of the court to the various orders made by the various court i.e the FHC,NICN,FCT and the issues still pending before the Appeal court, where the counsel to the AGF, had informed the appeal court that orders have been made by 3 different court.

Defence counsel is still citing cases to back up his point as to why the tribunal should obey the subsisting court orders as at the time of filing this report.
