President-elect Tinubu, APC seek dismissal of APM's petition says it lacks merit

The All Progressives Congress, APC and its presidential candidate Bola Ahmed Tinubu have asked the Presidential Election Petition Tribunal in Abuja to dismiss in its entirety a petition filed by the Allied People’s Movement, APM

APC and Bola Tinubu at a prehearing session of the tribunal argued that the petition filed by the Allied People’s Movement was worthless as it disclosed no reasonable cause of action.

In their separate motions on notice, the APC and the president-elect told the Tribunal that the petition filed by the APM is incompetent on various grounds and does not deserve to be given precious time by the Tribunal.

Counsel to the APC Lateef Fagbemi insisted in the motion that the election being challenged by APM was lawfully conducted and a clear winner declared in line with the provisions of the law.

At the proceedings, the senior lawyer while notifying the Tribunal of the motion on notice said it would be fully argued at the appropriate time.

He confirmed that he had answered all the questions on the pre-hearing Form TF008 Information sheet as required by law.

In his submission, Akin Olujimi Asiwaju Bola Ahmed Tinubu and Senator Kashim Shetima informed the Tribunal that he had filed a pre-hearing information sheet on 3rd May.

He notified the Tribunal of his pending motion on notice praying for outright dismissal of the petition for various reasons.

Counsel to the APM adopted his form TF008 pre-hearing sheet filed on April 28.

After taking arguments at the pre-hearing session, Chairman of the Tribunal, Justice Haruna Tsammani fixed 11th May for further pre-hearing session.

The court also held a prehearing session for the petition filed by the People’s Democratic Party.

All parties adopted the answer in their prehearing information sheet.

Counsel to the PDP sought to move an application, seeking a live broadcast of the tribunal proceedings, citing overriding concerns and public interest.

The chairman of the panel held that all applications will be taken together.

The tribunal also fixed 11th May for further prehearing.

Justice Tsammani ordered parties in the matter to sort out and agree on all documents they intend to tender during the hearing of the petition.
