Group seeks damages on alleged breach of Federal character

Leader of Pan Niger Delta forum, Edwin Clark and 15 others have approached the Federal high court Abuja, challanging the method of governance by President Muhammadu Buhari.

In the suit the plaintiffs are claiming N50 billion naira damages against the president, Attorney General of the Federation, and the Federal character Commission for the alleged breach of the provisions of section 14,15,16, 17,153,216,217 and 218 of the 1999 constitution.

These provisions enjoin the operations of the Federal character in all appointments made available in the Federal system of government.

The plaintiffs claims that key positions in the security sector of the country are being heads by people from a particular ethnic group and religion especially from the northwest and northwest

Counsel to the plaintiffs,  Mike Ozekhome noted that the Case is not divisive but one begging the government to bring about constitutional indivisible as envisaged in the preamble to the 1999 constitution.

The plaintiffs are seeking nullification of a key appointment in the security sector dominated by a particular ethnic groups which is against the Federal character principle.

Also a perpetual injunction restraining the President and other defendants in the suit from continuing to breach the constitution.

The matter could not be heard as parties and  counsel to the defendant were absent from court.

Court adjourns to 10 th for hearing.
